Felts v. Reed

The Clinic challenged an unconstitutional restriction on speech in a public forum by an elected official who blocked the Clinic’s client from his Twitter account after she tagged him in a Tweet questioning one of his policy positions. Following a bench trial, the court entered judgment in our client’s favor, concluding that our client was blocked from the official’s government-controlled Twitter account in an act of unconstitutional viewpoint discrimination. The court granted declaratory relief and nominal damages to our client and also awarded our client attorneys’ fees for work performed by the Clinic and co-counsel.
