Jennings v. University City

The Clinic represented two musicians in challenging a city’s obstruction ordinance and related policies that were used to prohibit our clients and other speakers from engaging in protected speech on public sidewalks and on private areas adjacent to public sidewalks. After the lawsuit was filed, the city amended its overly broad obstruction ordinance and agreed to temporarily alter enforcement of its policies while the lawsuit was pending. The court ultimately granted our clients’ motion for summary judgment and entered judgment in their favor on all counts of the complaint, concluding that the challenged ordinance and policies violated the First Amendment and Due Process Clause and awarding declaratory relief and nominal damages to our clients. The court also awarded attorneys’ fees for work performed by the Clinic and co-counsel at ACLU of Missouri and litigation costs.
